Terms & Conditions — NgeHit

1. Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and PT Akses Digital Indonesia governing your access to and use of the NgeHit platform, website, APIs, and all associated services (the “Service”).

By accessing or using the Service, you confirm that: (a) you are at least 13 years of age; (b) if you are between 13–17, you have parental/guardian consent; (c) you have legal capacity to enter into a binding agreement; and (d) you accept these Terms in full.

2. Service Description

NgeHit is a Social Media Management (SMM) platform that enables users to:

• Connect and manage multiple social media accounts from a single dashboard
• Schedule and publish content to connected social media platforms
• Create, edit, and store media content (images, videos)
• Access AI-powered content creation tools
• Research trending content topics and viral trends
• View analytics and performance data for published content
• Manage social inbox (comments, DMs) across platforms

The Service is provided “as is” and is subject to change.

3. Account Registration and Security

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Not share your account credentials with any third party
• Immediately notify us at [email protected] of unauthorized access
• Accept responsibility for all activities under your account

4. Subscription Plans and Billing

• Subscriptions billed monthly or annually in advance
• Processed via Midtrans (credit cards, bank transfer, IDR e-wallets)
• All prices in IDR and include applicable taxes
• Auto-renews unless cancelled before renewal date

4.3 Cancellation and Refunds

• Cancel any time through account settings
• Paid plan remains active until end of current billing period
• After cancellation, account reverts to Free plan
• No refunds for partial billing periods (except where required by Indonesian consumer protection law)
• For service outages directly caused by NgeHit exceeding 48 hours, pro-rated credit available

4.4 Free Trial

Paid plans may offer a 7-day free trial. You will not be charged during the trial period and we will notify you before it ends.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes. You must NOT:

• Violate Indonesian or international laws or regulations
• Post illegal, defamatory, obscene, hateful, or harmful content
• Infringe intellectual property rights of others
• Distribute spam, malware, or harmful software
• Conduct unauthorized scraping or data harvesting
• Attempt to gain unauthorized system access
• Impersonate any person or entity
• Reverse engineer or decompile the Service
• Resell or sublicense access without written consent
• Create multiple free accounts to circumvent plan limitations

Violations may result in immediate suspension or termination without refund.

6. Third-Party Social Platform Compliance

• You must comply with each connected platform's terms (Meta, TikTok, Google/YouTube, Twitter/X, etc.)
• You remain responsible for all content published through NgeHit
• NgeHit cannot guarantee continued feature access if platforms modify their APIs
• You grant NgeHit OAuth permissions necessary to perform your requested actions
• You can revoke permissions at any time through each platform's settings

7. Intellectual Property

7.1 NgeHit IP

The Service, including its content, features, design, and software, is owned by PT Akses Digital Indonesia and protected by Indonesian and international IP laws.

7.2 Feedback

By submitting feedback, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use it.

8. User Content

You retain full ownership of all content you upload (“User Content”). You grant us a limited license to host, process, transmit, and display it solely for operating the Service.

• You own or have the necessary rights to all User Content
• Your content does not violate IP, privacy, or other rights
• Your content complies with all applicable laws and platform terms

9. Disclaimers and Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, including but not limited to merchantability, fitness for a particular purpose, accuracy of analytics, or guaranteed posting times.

10. Limitation of Liability

To the maximum extent permitted by law, PT Akses Digital Indonesia shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or other intangible losses
• Damages arising from third-party platform API failures, changes, or outages
• Unauthorized access to your transmissions or data
• Loss of content due to technical failures beyond our reasonable control

Our total aggregate liability shall not exceed the amount you paid for the Service in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless PT Akses Digital Indonesia from any claims arising from: (a) your use of the Service; (b) your User Content; (c) violation of these Terms; or (d) violation of third-party rights.

12. Termination

You may terminate your account at any time. We may suspend or terminate your account immediately for:

• Violation of these Terms or Acceptable Use Policy
• Law enforcement requests
• Unexpected technical or security issues
• Non-payment after due notice
• Extended inactivity (30 days notice for inactive free accounts)

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Indonesia. Disputes shall first be resolved through negotiation; if unresolved within 30 days, submitted to the competent Indonesian court. Consumers may also contact Badan Perlindungan Konsumen Nasional (BPKN).

14. Changes to Terms

• We'll update the “Last updated” date
• Email notification at least 14 days before material changes
• Banner notification in NgeHit dashboard
